TERMS OF USE
Welcome to Experts.MD. These Terms of Use govern your access to and use of the Experts.MD website and related services.

This is an agreement between you, the user ("Your" or "User" or "Users") of this website for any purpose, and Experts.MD ("Experts.MD," "we," "our," or "us") regarding your use of, without limitation, Experts.MD's website, database, computer, interactive information, communication, and transaction service allowing access to the any part of the platform, and related services (collectively, the "Services").
BY REGISTERING WITH OR USING EXPERTS.MD, YOU AGREE TO BE BOUND BY ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.
If you do not agree with the terms and conditions of this Agreement, please exit our site at this time.
1. About Experts.MD
Experts.MD is a professional expert witness directory and marketing platform that enables medical and healthcare expert witnesses and consultants to publish professional profiles, showcase expertise, and connect with attorneys, law firms, insurers, and other qualified users seeking expert services.

2. Eligibility
You may use the Services only if you satisfy each of the following:
- You are 18 years of age or older.
- You have the legal capacity to enter into a binding contract.
- You use the Services for lawful and professional purposes.
By using the Services, you represent and warrant that all information you provide is accurate and complete.
3. Account Registration
To access certain features, you must create an account and complete the registration process. Indoing so, you agree to each of the following:
- Provide accurate and current information
- Maintain the confidentiality of your login credentials.
- Notify us immediately of unauthorized access.
- Accept responsibility for all activity under your account.
Your receipt of an electronic confirmation from Experts.MD that your registration process is complete does not constitute an acceptance of your registration. Experts.MD may require additional verification information before accepting your registration and reserves the right at any time to decline, suspend, or terminate your membership as set forth in this Agreement.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Membership And Billing
Experts.MD offers both free and paid membership options.
4.1 Free Accounts
Free Memberships allow users to create a Premium Profile and explore the platform. Free Memberships may have limited feature access. The entire Profile will be displayed to qualified requestors of the information. Qualified requestors are those users who pay for the AssistedSearch service or such other service that allows the access to the Profile information.
4.2 Paid Memberships
Paid memberships provide enhanced access to features, dual-platform exposure (Experts.com and Experts.MD), and additional marketing features.
By purchasing a paid membership, you agree to:
- Pay all applicable fees;
- Allow Experts.MD to charge your payment method on a recurring basis; and
- Maintain accurate billing information.
4.3 Auto-Renewal
Paid memberships renew automatically. You will be sent an invoice thirty (30 days) prior to the Membership expiration date. If the renewal payment is not received by the due date, the Memberhsip will lose its enhanced paid-membership features.
4.4 Refunds
Membership fees are non-refundable, except where required by law. We will, however, refund a pro-rata share of the unused portion of the membership term.
4.5 Chargebacks
Unauthorized chargebacks may result in:
- Account suspension;
- Collection efforts; and
- Additional fees.
5. AssistedSearch Service
Experts.MD provides attorneys and qualified requestors with an optional AssistedSearch service. This service is:
- Offered for a flat fee;
- Performed by Experts.MD staff; and
- Designed to identify and recommend potential medical expert witnesses based on the requestor's criteria.
- The terms of each AssistedSearch service will be communicated with the attorney or requestor prior to the commencement of the service.
5.1 Not A brokerage or Intermediary
Experts.MD does not:
- Broker, negotiate, or arrange engagements between attorneys and experts;
- Participate in fee discussions;
- Act as an agent, representative, or intermediary for either party; or
- Guarantee that an expert will accept an engagement.
All professional engagements occur directly between the attorney/requestor and the expert.
5.2 Case-Specific terms
The scope, deliverables, and terms of each AssistedSearch request:
- May vary from case to case;
- Are defined in the correspondence, proposal, or invoice provided at the time the service is requested; and
- Supersede any general descriptions on the website.
6. Professional Responsibility
Experts.MD is not a law firm, medical provider, or professional services entity. We do not:
- Vet or endorse experts;
- Guarantee credentials or qualifications;
- Provide legal, medical, or professional advice; or
- Create or participate in professional relationships.
All engagements between experts and attorneys or requestors occur outside the platform.
7. User Content
You retain ownership of the content you submit ("User Content"), including:
- Profile information;
- CVs and credentials;
- Articles, case studies, or media; and
- Images, videos, and professional materials.
By submitting User Content, you grant Experts.MD a worldwide, non-exclusive, royalty-free license to:
- Display, distribute, and promote your profile;
- Index your content for search and SEO; and
- Use your content to operate and improve the Services.
You represent and warrant that:
- You own or have rights to your content;
- Your content is accurate and not misleading; and
- Your content does not infringe any third-party rights.
We may remove content that violates these Terms.
8. Prohibited Uses
You may not use the Services to:
- Engage in unlawful, fraudulent, or deceptive conduct;
- Misrepresent your identity, credentials, or qualifications;
- Upload harmful, defamatory, or infringing content;
- Scrape, harvest, or misuse platform data;
- Interfere with platform functionality; or
- Attempt to bypass security measures.
Violations may result in account termination and legal action.
9. AI-Generated Content Disclaimer
Experts.MD may use AI-assisted tools to enhance search, categorization, or user experience. AI-generated outputs:
- May contain inaccuracies;
- Should not be relied upon as professional advice; and
- Do not replace human judgment.
Users are responsible for verifying all information.
10. Privacy & Data Protection
Your use of the Services is also governed by our Privacy Policy, which is intended to comply with, as applicable:
- General Data Protection Regulation (GDPR) for EU/EEA users;
- California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA) for California users; and
- Other applicable data protection laws.
Subject to applicable law, you may have rights to:
- Access your personal data;
- Correct inaccuracies;
- Request deletion;
- Request data portability.
We do not sell personal data.
11. DMCA Notice & Copyright Policy
If you believe your copyrighted work has been used on Experts.MD without authorization, you may submit a DMCA notice to our designated agent:

12. Third-party Services
The Services may link to third-party websites or tools. Experts.MD is not responsible for:
- Third-party content;
- Third-party privacy practices; or
- Transactions conducted outside the platform.
You use third-party services at your own risk.
13. Service Availability
We strive for continuous uptime but do not guarantee:
- Uninterrupted access;
- Error-free operation; or
- Data preservation.
We may modify, suspend, or discontinue features at any time.
14. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of:
- Accuracy;
- Reliability;
- Fitness for a particular purpose; and
- Non-infringement.
Experts.MD does not guarantee that:
- Profiles will generate engagements;
- Search results will be error-free; or
- Platform visibility will lead to revenue.
Experts.MD may, at its sole discretion, take actions to verify the accuracy of information presented by Users of the Site. Such actions do not limit, expand, or otherwise affect its obligations under this Agreement. For an example, Experts.MD may endeavor to establish a user-initiated feedback system to allow you to evaluate the experts with whom you are dealing.
Experts.MD also encourages you to communicate directly with other Users or other professionals to help you evaluate with whom you are dealing. Please practice safe usage. If you have any concerns about an individual, take measures to safeguard yourself. Users may contact the regulatory agency in your state or local association to verify license or membership status where applicable. Information supplied by Users could be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. Experts.MD expects that you will use caution -- and common sense -- when using the Site.
15. Limitation of Liability
To the fullest extent permitted by law:
- Experts.MD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from or in connection with your use of the Services; and
- Our total liability for any claim arising out of or relating to the Services or these Terms shall not exceed the amount paid by you to Experts.MD in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability; in such cases, the above limitations may not apply to you to the extent prohibited by law.
16. Indemnification
You agree to indemnify, defend, and hold harmless Experts.MD, its parent company, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
- Your use of the Services;
- Your User Content;
- Your interactions with third parties; or
- Your violation of these Terms or applicable law.
17. Dispute Resolution
17.1 Binding Arbitration
Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved by binding arbitration administered in or near San Joaquin County, California, under the rules of a recognized arbitration provider. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
17.2 Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the fullest extent permitted by law, you agree not to participate in any class, collective, consolidated, or representative action against Experts.MD.
18. Governing Law
These Terms and any dispute arising out of or relating to them are governed by the laws of the State of California, without regard to its conflict-of-law principles.
19. Termination
We may suspend or terminate your access to the Services, in whole or in part, at any time if:
- You violate these Terms;
- You engage in fraudulent, abusive, or harmful conduct; or
- We are required to do so by law or regulatory authorities.
You may terminate your account at any time by following the instructions in your account settings or by contacting us. Upon termination, your right to use the Services will cease, but certain provisions of these Terms will survive, including those relating to intellectual property, disclaimers, limitations of liability, and dispute resolution.
Experts.MD reserves the right to modify or discontinue the Service or any portion thereof with or without notice to any User. Experts.MD shall not be liable to any User or any third party should Experts.MD exercise its right to modify or discontinue the Service, except that, if the service is discontinued though no fault of the User, a User who has paid an annual fee for services shall be entitled to a pro rata refund of the unused portion of the fee.
The termination of this Agreement shall terminate your access to the Services. Experts.MD shall not be liable to you or to any third party for termination of the Services for any reason. The termination of this Agreement does not relieve you of your obligation to pay any Fees accrued or payable to Experts.MD prior to the effective date of termination of this Agreement.
Upon termination of this Agreement, the perpetual license you have granted to Experts.MD shall continue. Provisions, which by their nature would be expected to survive termination, shall survive and remain in full force and effect in accordance with their terms.
20. Lawful Use and Violations of System and Network Security
Experts.MD Services may be used only for lawful purposes. You must comply with all applicable local, state, national and international laws, regulations or conventions, including without limitation those related to data privacy, international communications, and exportation of technical or personal data. You may not use the Experts.MD Services or Site for any criminal or illegal activities or any activities that might be legally actionable.
Violations of system and network security are prohibited. You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of the website or any session being conducted on the website. You may not misuse system resources including but not limited to employing posts or programs which consume excessive CPU time or storage space; permitting use of mail services, mail forwarding capabilities, POP accounts, or auto-responders other than for your own account. You also agree not to use your Experts.MD-issued password for any unauthorized or prohibited purpose. If you notice a problem with other members not following these Guidelines, please notify us by contacting Customer Support.
21. Offensive Material and Abuse
YOU UNDERSTAND THAT INFORMATION AVAILABLE TO YOU THROUGH THE EXPERTS.MD SERVICE MAY INCLUDE MATERIALS THAT ARE UNEDITED, SEXUALLY EXPLICIT OR OFFENSIVE TO YOU AND THAT YOUR ACCESS TO SUCH MATERIALS IS AT YOUR OWN RISK. EXPERTS.MD AND ITS AFFILIATES HEREBY DISCLAIM ANY RESPONSIBILITY FOR OR CONTROL OVER SUCH MATERIALS.
Experts.MD reserves the right to determine what constitutes Internet abuse and objectionable conduct. If Experts.MD believes, in its sole discretion, that a violation of these Guidelines has occurred, it may take responsive action. Such action may include, but not be limited to, permanent removal of illegal or inappropriate information or content, or suspension or termination of your membership and access to Experts.MD Services. Examples of objectionable conduct and content that violate these Guidelines include, but are not limited to, the following:
- Posting, transmitting, or linking to any text, image, file, code, or any other content or material on the Site in violation of any applicable state or federal laws.
- Posting, transmitting, or linking to any text or images that are sexually explicit, pornographic, racially or ethnically objectionable, or grossly offensive to the online community.
- Posting, transmitting, or linking to defamatory and libelous statements or other statements that would violate any third party's privacy or publicity rights.
- Impersonating any person or using a name that you are not authorized to use.
- Planning illegal activities, such as creating computer viruses, building a bomb, or counterfeiting money.
- Promoting any products or services that are unlawful at the location at which the content is posted or received.
- Posting any content that infringes any third party's intellectual property rights or violates any confidentiality agreements or contracts of employment.
- Posting, transmitting, or linking to statements that are intentionally false or misleading.
- Spamming, flaming, or other similar activities, including using information obtained from Experts.MD to communicate uninvited solicitations or to promote your products or services.
- Violating the guidelines for academic honesty or other unethical behavior.
22. Commerce On The Internet
Through your uses of our Service, you may have opportunities to order and purchase merchandise or services from other subscribers to the Experts.MD Service and Users of other communications outlets such as the Internet. You further acknowledge that all transactions relating to merchandise or services offered by you through the Experts.MD service, including but not limited to the purchase terms, payment terms, warrantees, guarantees, maintenance and delivery terms for such transactions are agreed to solely between you and third party purchasers. Experts.MD and its affiliates make no warranties or representations whatsoever with respect to your goods and services, or with respect to the qualifications of any third party purchaser. You agree not to resell, reproduce, or copy information obtained from Experts.MD or through Experts.MD Services, nor exploit your membership or association with Experts.MD for a commercial or advertising purpose, except as otherwise authorized herein, without the express written permission of a corporate officer of Experts.MD.
23. Experts.MD Property Rights
The content, layout, design, concept, and organization of the Experts.MD Site and Services are subject to Experts.MD's patents, copyrights, trade secrets, and other intellectual property rights. All rights are reserved.
You acknowledge and agree that Experts.MD owns all right, title and interest in (i) the Services; (ii) the Site; (iii) the technology available on the Services or the Site; and (iv) all copyrights, patents, trademarks and other intellectual property rights therein. Any use of the Experts.MD Services, Site, technology, and/or the copyrights, patents, trademarks or other intellectual property rights, other than as described in this Agreement, is not licensed and is strictly prohibited.
You agree that you will obtain the express written permission from Experts.MD before you copy, upload, transmit, reproduce, distribute or in any way exploit any Experts.MD Services, technology and/or the copyrights, patents, trademarks or the other intellectual property rights, obtained through the Experts.MD Site. In addition, you agree not to copy the layout, design, concept and organization of the Site or Services during the Agreement and for a period of five years after termination. This Agreement does not constitute a license to use Experts.MD's trade names, service marks or any other trade insignia. Any use of Experts.MD's trade names, services marks or any other trade insignia shall be subject to Experts.MD's prior written consent.
24. No Agency
Experts.MD is completely independent from you. You agree that you are not engaged in any agency, partnership, joint venture, employee-employer, franchisor-franchisee or any other similar type of relationship with Experts.MD, and no such relationship(s) are intended nor created by this Agreement.
25. Indemnification
Experts.MD provides its Services and website to Users on the assumption that you will act professionally and responsibly. If you do not, you must bear full responsibility for your actions. As a User of the Experts.MD Service, you agree to defend, indemnify and hold harmless Experts.MD, its officers, directors, employees and agents from and against all claims, demands, actions, suits, damages, liabilities and costs, including reasonable attorneys' and experts' fees, related to or arising from
- any breach of your covenants under this Agreement;
- your use of the Services or the website;
- all conduct and activities occurring under your User Name and password;
- any defamatory, libelous or illegal material contained within Your Content or your information and data;
- any claim or contention that Your content or your information and data infringes any third party's patent, copyright or other intellectual property rights or violates any third party's rights of privacy or publicity; and
- any third party's access or use of Your Content or your information and data. Experts.MD reserves the right, at its own expense, to participate in the defense of any matter otherwise subject to indemnification from you, but shall have no obligation to do so. You shall not settle any such claim or liability without the prior written consent of Experts.MD, which shall not be unreasonably withheld.
26. Export Control Compliance
You agree to abide by U.S. and other applicable export control laws and not to transfer, by electronic transmission or otherwise, any content or software subject to restrictions under such laws to a destination prohibited under such laws, without first obtaining, and then complying with, any requisite government authorization. You further agree not to upload to the Site any data or software that cannot be exported without prior written government authorization, including, but not limited to, certain types of encryption software.
The export control laws of the United States and other jurisdictions regulate the export of certain technology. This includes email transmission of certain information to foreign countries and foreign nationals. You agree to abide by these laws. Regrettably, nations of Cuba, Iraq, Iran, Libya, North Korea, and Syria may not legally access Experts.MD.
27. Consumer Rights
Pursuant to California Civil Code Section 1789.3 if you are a California resident you:
- may have these Terms of Service e-mailed to you by sending a letter to the foregoing address with your e-mail address and a request for this information;
- may obtain service pricing information on membership dues, fees, charges and rates by reviewing these Terms of Service, sending a letter to the foregoing address with your e-mail address and a request for this information or by calling 1-866-2-EXPERTS (866-239-7378)

28. No Assignment
Your rights and obligations under this Agreement shall not be transferred or assigned directly or indirectly without the prior written consent of Experts.MD.
29. Severability
If any provision of this Agreement or portion thereof is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Experts.MD's failure to act with respect to a breach by you or others does not waive Experts.MD's right to act with respect to subsequent or similar breaches.
30. Force Majeure
Experts.MD will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen contingency beyond the reasonable control of such party including without limitation Internet outages, communications outages, fire, flood, war, or act of God.
31. Changes To These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the Services after any changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.

33. Notices
Except as explicitly stated otherwise, all notices permitted or required under this Agreement shall be by email, to us at support@experts.MD, and to you at the email address you provide Experts.MD during the registration process, or to such other address as either of us shall specify in writing as our addresses for notice. Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Evidence of successful transmission shall be retained.
